1. Acceptance of Terms

By using this website, you agree to these Terms & Conditions. If you do not agree, please do not use the website. Additional terms presented during a specific service or transaction may also apply.

2. Website Use

You may use the website for lawful personal and business purposes related to learning about Funcle's Café, contacting us, requesting catering information, and using available ordering features. You are responsible for the accuracy of information you submit.

3. Menu Information

We aim to keep menu descriptions and prices accurate. Availability, ingredients, preparation, and prices may change, and errors may occasionally occur. Photographs are illustrative and presentation may vary. These terms do not permit us to knowingly display inaccurate information; when we identify an error, we may correct it and will address affected orders reasonably.

4. Allergies and Dietary Information

Customers with food allergies, sensitivities, or dietary requirements should contact Funcle's Café before ordering. Food may be prepared in areas where allergens are present, and cross-contact may occur. Website descriptions and customer notes are not a guarantee that an item is allergen-free or suitable for a particular dietary need.

5. Online Ordering

Online checkout is currently unavailable until the restaurant's ordering connection is configured. When online ordering is enabled, submitting an order does not guarantee acceptance. An order is accepted when the website provides an order confirmation or Funcle's Café otherwise confirms it.

When online ordering is available:

• items and pickup times remain subject to availability;
• you must provide accurate contact, order, and pickup information;
• you are responsible for reviewing selections, modifiers, quantities, and special instructions before submitting; and
• Funcle's Café may reject or cancel an order when an item or requested fulfillment cannot be provided, with any resulting payment issue handled as circumstances require.

6. Payments

When online payments are enabled, payments may be processed through Square. Payment details entered through Square are subject to Square's terms and privacy practices. The Funcle's Café website is designed to use a Square-generated payment token rather than receive or store raw payment-card numbers.

7. Pricing

Prices displayed on Funcle's direct website control direct website orders at the time an order is accepted. If a material pricing error affects an order, Funcle's Café may contact you to confirm the correct price or cancel the affected item or order.

8. Taxes and Fees

Applicable taxes and any clearly disclosed charges may be added to an order. The total presented for review before submission will reflect amounts calculated for that transaction.

9. Order Changes, Cancellations, and Refunds

For changes, cancellations, or concerns about an order, contact Funcle's Café as soon as possible at (203) 823-9661. Eligibility for cancellation, replacement, or refund may depend on the circumstances and whether preparation has begun.

10. Catering

A contact or catering-form submission is an inquiry only. It does not create a confirmed booking, reservation, menu commitment, or binding order. Availability, menu, pricing, guest count, timing, pickup or delivery arrangements, payment, and other final details must be separately confirmed by Funcle's Café.

11. Intellectual Property

The Funcle's Café name, branding, and original website content are protected by applicable intellectual-property laws and may not be copied, republished, or commercially used without permission. Third-party names, content, software, and services remain the property of their respective owners.

12. Third-Party Services

The website may use or link to third-party services, including Square when ordering is enabled, Google Maps, Google-hosted fonts, TrustIndex review displays, and hosting or form-delivery infrastructure. Those services operate under their own terms and policies. We are not responsible for third-party sites or services outside our control.

13. Prohibited Use

You may not use the website to:

• break the law, infringe another person's rights, or submit false or harmful material;
• interfere with website operation, security, or other customers' use;
• attempt unauthorized access to accounts, systems, data, or nonpublic areas; or
• use automated means to abuse forms, ordering features, or website resources.

14. Disclaimer of Warranties

We work to keep the website useful and accurate, but it is provided on an "as available" basis. To the extent permitted by law, we do not guarantee that the website will always be uninterrupted or error-free. This section does not limit any warranty or consumer right that cannot lawfully be excluded.

15. Limitation of Liability

To the extent permitted by law, Funcle's Café is not responsible for indirect or consequential loss arising solely from use of, or inability to use, the website or a third-party service. Nothing in these terms excludes liability that cannot lawfully be limited, and your applicable consumer rights remain unaffected.

These terms are governed by the laws of the State of Connecticut, without adding any separate arbitration or venue requirement.
